6. ‘Financial Fitness score’ means the proprietary numerical assessment generated by our algorithm based on user inputs and our internal weightings and assumptions.

8. ‘Linked Sites’ means third-party websites accessible through links on the Site.
9. ‘Account’ means the personal user profile and associated credentials created by a User to access certain features of the Service.

You hereby consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications that the Company provides to you electronically, whether via email or through the Site, shall satisfy any legal requirement that such communications be made in writing.

By accessing and using this Site, User shall be solely responsible for (i) maintaining the confidentiality of User’s account credentials, including username and password; (ii) restricting unauthorized access to User’s computer and account; and (iii) all activities that occur under User’s account credentials. User’s account rights are non-assignable and non-transferable to any other person or entity. User acknowledges that Anascore, Inc. shall not be liable for any unauthorized third-party access to User’s account resulting from theft or misappropriation of User’s credentials. An authorized representative of Anascore, Inc. shall be permitted to access User’s account data solely under the following circumstances: (i) when necessary to resolve technical issues reported by User to Anascore, Inc.’s support team; (ii) to investigate potential violations of these Terms of Service; or (iii) as required by applicable law or regulation. Any such access shall be documented and conducted in strict accordance with Anascore Inc.’s Privacy Policy and applicable data protection laws.

Anascore, Inc. does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.finmagix.com only with permission of a parent or guardian.

Without obtaining Anascore Inc.’s prior written permission, User hereby expressly covenants and agrees not to engage in any of the following activities (each a “Prohibited Activity”). Any violation of these restrictions shall constitute a material breach of these Terms and shall entitle Anascore Inc., in its sole discretion, to pursue any or all of the following remedies: (i) immediate termination of User’s account without prior notice; (ii) forfeiture of any and all accrued benefits, privileges, or credits; (iii) legal action, including but not limited to claims for monetary damages, injunctive relief, and specific performance; and (iv) any and all other remedies available at law or in equity:

1. Modify, adapt, translate, or reverse-engineer any part of the Service;
2. Utilize robots, spiders, scrapers, deep links, or other automated data-gathering tools, programs, algorithms, or methods to access, retrieve, copy, or monitor the Service or any part thereof;
3. Remove any copyright, trademark, or other proprietary rights notices displayed on or contained within the Service or any Content accessed via the Service;
4. Reformat, frame, overlay pop-up windows on, or otherwise alter the appearance or display of any portion of the Service;
5. Create user accounts through automated methods or under deceptive or fraudulent pretenses;
6. Impersonate any individual or entity, including Anascore Inc.’s employees, officers, directors, or representatives, or falsely state or otherwise misrepresent User’s affiliation with any individual or entity;

If User accesses the Service from a location outside the USA, User shall be solely responsible for ensuring compliance with all applicable local, national, and international laws, regulations, and directives. User hereby represents and warrants that User shall not access or utilize any Anascore Inc. The analyses and estimations provided through our Services are intended solely for informational and illustrative purposes and do not constitute financial advice. All calculations are derived from (i) predetermined financial and mathematical assumptions, (ii) user-provided data, and (iii) proprietary algorithmic methodologies. Such analyses and estimations are generated independently and are not endorsed by, or created at the request of, any third-party partners. Anascore Inc. maintains sole and absolute discretion regarding the methodology used to determine, weigh, include, exclude, or emphasize various factors in its calculations and presentations.

The Financial Fitness Score (“Score”) is a proprietary numerical assessment designed to provide users with a general indication of their financial standing based on various factors. The Score:

a) Is calculated using our proprietary algorithm that processes user-providedinformation along with internally developed assumptions, weightages, and analytical factors;

b) Is provided for informational and educational purposes only and should not be considered as financial advice;

c) Is not a credit score and is not used for lending decisions;

d) May change or fluctuate based on updates to user inputs, modifications to our algorithm, or other factors within our discretion;

e) Should not be used as the sole basis for making financial decisions;

f) Does not guarantee improvement in your financial circumstances or predict future financial outcomes;

g) Is not shared with or influenced by any third-party financial institutions;

h) May not be comparable to similar scores or assessments provided by other services.

Users acknowledge that the Score is one of many tools that may be used to assess financial health and should be considered alongside other relevant factors and professional advice when making financial decisions.

Anascore, Inc. explicitly disclaims any role as a financial advisor, investment advisor, legal advisor, tax advisor, or any similar professional capacity as defined by federal, state, or international statutes and regulations. Anascore, Inc. is not a registered investment advisor or financial planner. The Finmagix app (“App”) generates a Financial Fitness score (“Score”) using the Company’s proprietary algorithm, which processes user- provided information along with internally developed assumptions, weightages, and other analytical factors. The Fitness Score is not a credit score and is not used for lending decisions. Anascore, Inc. assumes no liability for any user’s reliance on the Score or any recommendations provided through the Service. Users expressly acknowledge that: (1) the Score and all related analyses are provided strictly for informational and educational purposes only; (2) the Score should never be relied upon as the sole or primary basis for any financial, investment, legal, or tax decisions; (3) the Score and underlying calculations may fluctuate or change without notice based on modifications to user inputs, algorithm updates, or other factors within the Company’s discretion; (4) no aspect of the Services, including but not limited to the Score, financial analyses, educational materials, or other app features, constitutes or should be interpreted as personalized professional advice; (5) the Company makes no representations, warranties, or guarantees, express or implied, regarding improvement of users’ financial circumstances, investment returns, or overall financial well-being; and (6) users assume full and complete responsibility for all decisions regarding if, when, and how to utilize the Services and information provided by the Company. Users are strongly encouraged to consult with qualified financial, investment, legal, and tax professionals before making any significant financial decisions.

You agree to indemnify, defend and hold harmless Anascore Inc, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Anascore Inc reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Anascore Inc in asserting any available defenses.

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Anascore, Inc. agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. ANASCORE, INC. AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

ANASCORE, INC. AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ANASCORE INC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
